Belton Health provides assistive wellness and mobility products.
Not Medical Advice: Our products are not intended to replace professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or a qualified healthcare provider regarding any physical condition or mobility limitation.
Assumption of Risk: Bathing and showering are inherently risky activities due to wet and slippery surfaces. By purchasing and using our products, you acknowledge these risks and agree that the use of any Belton Health product is at your own risk.
SECTION 2 - LIMITATION OF LIABILITY & ACCIDENT RELEASE
To the maximum extent permitted by applicable law, Belton Health shall NOT be liable for any personal injury, death, or property damage arising out of or related to the use of our products. This includes, but is not limited to:
Falls or Slips: Any incident occurring while using, entering, or exiting the product.
Improper Assembly: Any injury resulting from failure to strictly follow the provided assembly manual or failure to verify that all locking mechanisms are securely engaged before use.
Surface Failure: Use of the product on uneven surfaces, grout lines, or dirty floors that compromise suction-cup stability.
Weight Capacity: Exceeding the stated maximum weight capacity (e.g., 400 lbs / 181 kg).
Lack of Maintenance: Failure by the user to perform routine safety checks before each use.
SECTION 3 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Belton Health and our affiliates, partners, and employees from any claim or demand, including reasonable attorneys’ fees, made by you or any third party (including family members or insurance providers) arising out of your use of the product or breach of these Terms.
SECTION 4 - GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Spain. Any legal action or proceeding related to your access to, or use of, the Site or our products shall be instituted exclusively in the applicable courts located in Madrid, Spain.
