This website is operated by Belton Health. Throughout the site, the terms "we", "us" and "our" refer to Belton Health. Belton Health offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

SECTION 1 – MEDICAL & SAFETY DISCLAIMER

Belton Health provides assistive wellness and mobility products.

Not Medical Advice: Our products are not intended to replace professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or a qualified healthcare provider regarding any physical condition, balance issue, or mobility limitation, and to confirm that the product is appropriate for your individual needs.

Assumption of Risk: Walking, standing, and moving with the assistance of a mobility device involve inherent risks, including loss of balance and falls, particularly on uneven, wet, or slippery surfaces. By purchasing and using our products, you acknowledge these risks and agree that the use of any Belton Health product is at your own risk.

SECTION 2 – LIMITATION OF LIABILITY & ACCIDENT RELEASE

To the maximum extent permitted by applicable law, Belton Health shall NOT be liable for any personal injury, death, or property damage arising out of or related to the use of our products. This includes, but is not limited to:

  • Falls or Slips: Any incident occurring while using, leaning on, standing up from, or sitting down with the product, or while moving with it.
  • Improper Assembly or Adjustment: Any injury resulting from failure to strictly follow the provided assembly manual, failure to correctly adjust the product (such as height settings) to the user, or failure to verify that all locking mechanisms, brakes, and folding joints are securely engaged before use.
  • Surface & Environmental Conditions: Use of the product on uneven, wet, slippery, sloped, or obstructed surfaces, or on stairs, escalators, or other surfaces for which the product is not intended.
  • Weight Capacity: Exceeding the stated maximum weight capacity
  • Lack of Maintenance: Failure by the user to perform routine safety checks before each use, including inspection of wheels, tips, brakes, fasteners, and structural components for wear or damage.
  • Misuse: Any use of the product in a manner inconsistent with its intended purpose or the instructions provided.

SECTION 3 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Belton Health and our affiliates, partners, and employees from any claim or demand, including reasonable attorneys' fees, made by you or any third party (including family members, caregivers, or insurance providers) arising out of your use of the product or breach of these Terms.

SECTION 4 – GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Spain. Any legal action or proceeding related to your access to, or use of, the Site or our products shall be instituted exclusively in the applicable courts located in Madrid, Spain.
